These Terms of Use (the “Terms”) govern your use of the Voxa: Live Translate app (also known as VoxaTranslate, the “App”) and the related online services (together, the “Service”) provided by the developer of the App (“we”, “us”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Service.
1. The Service
The Service provides real-time speech interpretation: audio from your microphone is sent to our servers, processed by cloud AI models, and returned to you as subtitles and, if you choose, as synthesized speech. The Service also provides photo translation: a photo you take or choose is sent to our servers, where a cloud AI model translates the text in it and produces a translated image that keeps the original layout, and text translation: text you type is sent to our servers, translated by a cloud AI model and returned to you. The Service requires an internet connection. Supported languages, voices and features may change over time.
2. AI Output and High-Risk Use
- Recognition, translation, synthesized speech, the translated images produced by photo translation and the translations produced by text translation are generated automatically by AI and may be inaccurate, incomplete, delayed or inappropriate. They do not represent our views. Translated images may also leave some text untranslated or change the original layout.
- Do not rely on the Service as the sole basis for decisions in medical, legal, financial, safety-critical, emergency or other high-risk situations. In such situations, use a qualified human interpreter.
- You are responsible for how you use the output, and for checking it where accuracy matters.
- When others’ speech is captured, you are responsible for obtaining any notice or consent required by law in your location. The same applies when you take photos that show other people or their personal information, or type text that contains other people’s personal information.
3. Your Account
- You can sign in with an email verification code or with Sign in with Apple. An account is for one person; keep your devices and email account secure. You are responsible for activity under your account.
- You must be at least 14 years old, or the minimum age required in your country or region; if you are below the age at which you can consent on your own, you may use the Service only with the consent of your parent or guardian.
- Deleting your account: you can delete your account at any time in the App under Account → Delete Account. Your personal information is then handled as described in the Privacy Policy. Remaining minutes, including top-up pack balances, are forfeited and cannot be restored, except that an active membership can be restored on a new account as described in Section 5.3. Deleting your account does not cancel an App Store subscription; cancel it in your App Store account settings. Signing in again later creates a brand-new account.
4. Acceptable Use and Fair Use
You agree not to:
- use the Service for any unlawful purpose, or to process content that infringes the rights of others or is illegal, harassing or harmful;
- interfere with or circumvent the measurement of usage or billing, or any security or usage limits;
- reverse engineer, decompile or attempt to extract the source code of the App, except where the law expressly permits;
- access the Service through automated means or unofficial clients, resell it, or share an account with others;
- overload, attack or disrupt the Service or its infrastructure.
To keep the Service available to everyone, usage limits may apply, such as a maximum length for a single session, one session at a time per account, automatic ending of a session after a period without detected speech, the number of free photo and text translations available to non-members, a daily limit on photo and text translations for members, and a maximum length for a single text translation. We may suspend or terminate accounts that violate these Terms.
5. Minutes, Membership and Payments
5.1 How usage is measured
- Minutes are deducted only for the time speech is detected in your audio, as measured by our servers, plus a short buffer (about 0.3 seconds) before and after speech so that the beginnings and ends of words are not cut off. Silence is not counted. Sounds loud enough to be detected as speech, such as nearby conversations or music, may be counted.
- The same rate applies whether or not voice playback is turned on.
- The App does not report usage; our servers’ measurement determines the minutes deducted. Contact us if you believe a deduction is wrong.
- Photo translation and text translation do not deduct minutes. Members can use photo translation and text translation (a reasonable daily limit may apply); non-members can use each free of charge a limited number of times, counted separately, as shown in the App. Attempts that fail or find no text in the photo are not counted.
5.2 Free trial minutes
New accounts may receive free trial minutes with a limited validity period, as shown in the App. Trial minutes are not a membership.
5.3 Membership (auto-renewable subscription)
- Membership is offered as a monthly or annual auto-renewable subscription. On the mainland China App Store the prices are ¥59 per month and ¥588 per year; prices in other countries and regions are set locally. The price shown in the App Store at the time of purchase applies.
- Each membership includes 60 minutes per month. For annual membership, the minutes are granted month by month. Each month’s minutes are valid only for that month, unused minutes do not roll over, and a new allowance is granted each month.
- Payment is charged to your Apple ID account when you confirm the purchase. The subscription renews automatically unless it is turned off at least 24 hours before the end of the current period, and your account will be charged for renewal within 24 hours before the end of the current period. You can manage and cancel your subscription in your App Store account settings; cancellation takes effect at the end of the current period.
- If a free trial or introductory offer is provided, any unused portion of it is forfeited when you purchase a subscription, where applicable.
- Upgrading from monthly to annual membership takes effect immediately: the unused minutes of the current monthly period end, and the first month of annual membership begins. Any proration is handled by Apple.
- If Apple grants a billing grace period after a failed renewal payment, your membership remains active during that grace period.
- A membership belongs to the account that purchased it, not to your device or Apple ID. Restoring purchases while signed in to a different account does not move the membership to that account. If the original account has been deleted, restoring purchases on a new account moves the membership and its remaining minutes for the current period to the new account. If you can no longer access the original account, contact us.
5.4 Top-up packs
- Top-up packs provide additional minutes. Top-up minutes never expire, but they can be used only while your membership is active.
- If your membership ends, your top-up balance is kept and becomes usable again as soon as you renew or subscribe again.
- Membership minutes for the current month are used first; top-up minutes are used after them.
- Top-up packs are consumable purchases tied to the account that bought them. They cannot be transferred to other accounts or restored after account deletion.
5.5 Refunds
All payments are processed by Apple. Refunds are handled by Apple under its policies, which you can request at reportaproblem.apple.com; we cannot issue refunds directly. If a purchase is refunded, the minutes granted by it that have not yet been used are revoked; minutes already used are not reclaimed.
5.6 Changes to prices and plans
We may change prices, plans, minute allowances or features in the future. Changes do not affect a period you have already paid for. Subscription price increases are handled in accordance with Apple’s rules, including any required notice or consent.
6. Intellectual Property and Your Content
The App and the Service, including their software, design and trademarks, belong to us or our licensors. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. You keep all rights to the speech, photos and text you input and to the output generated for you. You grant us only the permission needed to process them in real time to provide the Service; we do not store them.
7. Third-Party Services
The Service relies on third-party services, including Apple (sign-in and payments), Tencent Cloud (hosting) and Alibaba Cloud (AI processing and email delivery). Your use of Apple’s services is also subject to Apple’s terms. Interruptions or changes to these third-party services may affect the Service.
8. Availability and Changes to the Service
We aim to keep the Service available but do not guarantee that it will be uninterrupted or error-free; network conditions, maintenance and third-party services may cause interruptions. We may modify or discontinue features. If we discontinue the Service as a whole, we will give at least 30 days’ notice in the App and will handle any remaining paid balances in accordance with applicable law.
9. Disclaimer
To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of accuracy, fitness for a particular purpose and non-infringement. Nothing in these Terms limits any consumer rights that cannot be excluded or limited under the law that applies to you.
10. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or for any loss of profits, data or business opportunities, arising from your use of or inability to use the Service, including reliance on AI output. Our total liability for all claims relating to the Service is limited to the amount you paid for the Service in the 12 months before the event giving rise to the claim. These limitations do not apply to liability that cannot be limited by law, such as liability for intentional misconduct or gross negligence, or for personal injury caused by us.
11. Suspension and Termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you seriously or repeatedly violate these Terms, if required by law, or to protect the Service or other users; where reasonable, we will tell you the reason. Sections that by their nature should survive termination (including disclaimers, limitation of liability and governing law) will survive.
12. Changes to These Terms
We may update these Terms. We will publish the updated version on this page with new dates and, for material changes, notify you in the App. If you continue to use the Service after the changes take effect, you accept the updated Terms; if you do not agree, stop using the Service and delete your account.
13. Governing Law and Disputes
These Terms are governed by the laws of the People’s Republic of China (for the purposes of these Terms, excluding the laws of the Hong Kong and Macao Special Administrative Regions and Taiwan). Any dispute should first be resolved through friendly negotiation; if negotiation fails, either party may bring the dispute before a competent people’s court at the place where we are located. If you are a consumer, this does not deprive you of the protection of mandatory provisions of the law of the country where you habitually reside.
14. Additional Terms for Apple Devices
- These Terms are between you and us only, not with Apple Inc. (“Apple”). We, not Apple, are solely responsible for the App and its content.
- Your license to use the App is limited to use on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
- We are solely responsible for providing maintenance and support for the App. Apple has no obligation to furnish any maintenance or support services.
- If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App; any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are our responsibility.
- We, not Apple, are responsible for addressing any claims by you or any third party relating to the App or your possession and use of it, including product liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar laws.
- If a third party claims that the App or your possession and use of it infringes that third party’s intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of the claim.
- You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- You must comply with applicable third-party terms of agreement when using the App.
- Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
